ELIGIBILITY-TERMS & CONDITIONS
I. Go Dutch Rewards is owned and operated by Dutch Heating and Cooling LLC. Go Dutch Rewards terms and conditions form the agreement (the “Agreement”) between you (“You”) and Dutch Heating and Cooling LLC and its affiliates and subsidiaries (“Company”). II. Agreement to Terms. You agree to read these terms and conditions carefully before using the Go Dutch Rewards program. If you do not agree to these terms and conditions, you may not participate in the Go Dutch Rewards program. Use of the Go Dutch Rewards program signifies your agreement to the terms and conditions of use set forth below.
III. Modification of Agreement. Company reserves the right, at its sole discretion, to change, modify, add or remove any portion of this Agreement, in whole or in part, at any time. Notification of changes in the Agreement will be posted on www.GoDutchRewards.com (the “Website”). Use of the Go Dutch Rewards program after such notice will be considered your agreement to be bound by any such changes.
IV. Minimum Age Requirement. You must be at least 18 years old to apply for and hold a Go Dutch Rewards account.
V. Company’s rights in Go Dutch Rewards Program. Company may change, suspend or discontinue any aspect of the Go Dutch Rewards program at any time. Company may also impose limits on membership eligibility, certain features and services or restrict your access to parts or all of the Go Dutch Rewards program or the website without notice or liability. Company reserves the right, in its sole discretion, to refuse service, cancel membership, suspend or terminate an account.
VI. Indemnification for Your breach of Agreement. You hereby agree to indemnify, defend and hold Company, and all its officers, directors, owners, agents, employees, information providers, licensors and licensees (collectively, the “Indemnified Parties”) harmless from and against any and all liabilities and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach by You of the Agreement or the foregoing representations, warranties and covenants, including, without limitation, attorneys fees and costs. You shall cooperate as fully as reasonably required in the defense of any claim. Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by You and You shall not in any event settle any matter without the written consent of Company.
VII. Limitation of Company’s liability and damages. In no event shall Company be liable for any loss arising out from lost or stolen Go Dutch Rewards cards, nor for any direct, indirect, special, consequential or other damages arising out of the use of the Go Dutch Rewards program or the website. This includes, without limitation, lost profits, business interruption, damage to equipment, computer systems or programs, or any information system, or the loss of any information or data. The maximum liability collectively of the Company shall not exceed one hundred dollars ($100) for any damages of any nature, including gross negligence, arising in contract, tort or otherwise.
VIII. Entire Agreement. These terms and conditions constitute the entire agreement between Company and You with respect to your use of the Go Dutch Rewards program. Any cause of action You may have with respect to your use of the Go Dutch Rewards program must be commenced within one (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of the Agreement, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the Agreement, and the remainder of this Agreement shall continue in full force and effect.
IX. Membership in the program is free and no initial purchase is required.
X. All information collected about the consumer during the course of business with Company is maintained with complete confidentiality. No information gathered will be sold, released or given away.
XI. Rewards program is for individual residential service inside our service areas only. Program membership is not guaranteed to corporations, businesses, charities, partnerships, enterprises, or any other entity. Only one enrollment per household. One program card per household is issued. Additional cards can be requested up to a total of 3 cards per household.
XII. By participating in the program, You agree to allow Company to communicate via mail, email, phone, external websites and various other channels. If permission is granted by You, Company may also communicate via text or mobile device. Company may use these channels to communicate to You account status, when You are eligible for a reward, communicate program changes, offer special promotions, coupons, information and offerings that we believe may be of interest to You, and more. By enrolling in this program You agree to allow us to send You promotional items and contest prizes. You may decline promotional items or contest prizes.
XIII. You agree to notify us of any changes to Your name, address, email or phone number, by email using our Company website contact information tools or mail your request to our address listed on the Company website.
XIV. Rewards program has no cash value and is not valid with any other offers.
XV. 15% OFF ALL REPAIRS (UNLIMITED) is defined as the discount applies to each listed repair on a repair invoice. There is no maximum limit or expiration while actively enrolled in the program.
XVI. 15% OFF ALL NEW EQUIPMENT INSTALLATION (UNLIMITED) is defined as the discount applies to each listed installation on an invoice. There is no maximum limit or expiration while actively enrolled in the program.
XVII. 10% OFF NEW ACCESSORIES INSTALLATION (UNLIMITED) is defined as the discount applies to each listed installation on an invoice. There is no maximum limit or expiration while actively enrolled in the program.
XVIII. $59 HEATING MAINTENANCE (UNLIMITED) is defined as the discounted price applies to each unit of equipment that produces heat. Dual fuel heating combinations are priced at $88 per system. There is no maximum limit or expiration while actively enrolled in the program.
XIX. $59 AIR CONDITIONING MAINTENANCE (UNLIMITED) is defined as the discounted price applies to each unit of equipment that produces air conditioning. There is no maximum limit or expiration while actively enrolled in the program.
XX. WILL MATCH OR BEAT COMPETITOR COUPONS is defined as coupons in writing or online (that can be printed), issued by competing companies within our service area that are licensed and insured. Company will not honor coupons for services or products that Company does not offer. Coupons must be considered reasonable offers for industry standards or it will not be honored. Company reserves the final right to decide what coupons will be honored.
XXI. WILL MATCH OR BEAT COMPETITOR PRICING is defined as pricing in writing or online (that can be printed), issued by competing companies within our service area that are licensed and insured. Company will not honor pricing for services or products that Company does not offer. Pricing must be considered reasonable for industry standards or it will not be honored. Company reserves the final right to decide what pricing will be honored.
XXII. PRIORITY SERVICE is defined as priority scheduling for emergency repair service for program members over others that are not in any of Company’s programs.
XXIII. FREE SECOND OPINIONS is defined as no service call fee for diagnostics for a prior diagnostic that was put in writing made by competing companies.
XXIV. TWO YEAR PARTS AND LABOR WARRANTY ON REPAIRS is defined as repairs done by Company while You are actively enrolled in program.
XXV. FREE PHONE SUPPORT AND ADVISEMENT (UNLIMITED) is defined as information passed onto You over the phone to assist with residential heating and cooling equipment and accessories. It does not cover business or commercial needs. Company has the right not offer information on repairs that Company considers dangerous to You. This service is not meant for training You on how to repair Your own equipment. Company is not liable for Your actions based on Company’s support and advisement. Maintenance, repair, service and installation should be done by a qualified HVAC technician. Company reserves the final right to determine what information is to be given out. Due to potential high call volume Company may elect to schedule phone support and advisement with You at a time that is convenient to Company and You.
XXVI. CONSUMER HOW-TO-VIDEOS are for Your familiarity only. This service is not meant for training You on how to repair Your own equipment. Company is not liable for Your actions based on Company’s how-to-videos. Maintenance, repair, service and installation should be done by a qualified HVAC technician.
XXVII. To un-enroll from this program please email Company using Company website contact information tools or mail Your request to Company address listed above.
XXVIII. Company shall not be liable for any delay or damage due to delay from any circumstance beyond its control including strikes, accidents, utility outages, foul weather, safety hazards, consumer interference, acts of God, illness, injury, or general unavailability of materials.
XXIX. The Go Dutch Rewards Program is not an insurance policy or a warranty program for existing heating/cooling equipment and accessories. However new parts installed while enrolled into program are with a warranty for 2 years on parts and 2 years on labor.
